Studentawards “Holiday Deals” Contest
Official Contest Rules (the "Rules")
The Contest is intended to be conducted in Canada only and is subject to applicable Canadian federal, provincial and municipal law. Entry in the Contest constitutes acceptance of these Rules.
1.
Who Can Enter. The Studentawards Holiday Deals Contest (the “Contest”) is open to any person who is (i) 13 years of age and older at time of entry, (ii) a studentawards.com or boursetudes.com member, (iii) a Canadian citizen or permanent resident of Canada, residing in Canada (excluding Quebec), on the Contest Closing Date, and (iv) enrolled in a Canadian High School, CEGEP, College, or University for the 2012-2013 school year. Studentawards Inc. (the “Sponsor”) and each of the individuals associated with the Contest, including the Sponsor’s employees, directors, officers, agents, representatives, promotional and marketing agencies, and any member of the immediate families of any of the foregoing and other individuals with whom any of the foregoing are domiciled, are not eligible to participate in the Contest.
2.
Contest Period. The Contest ends on Friday, January 11, 2013 at 3:00 p.m. Eastern Time (ET) (the "Contest Closing Time").
3.
How to Enter. No purchase necessary.
To enter the draw, a Member must complete all the required fields in the Contest’s “Entry Form” on the Studentawards website and and submit the Entry Form to studentawards.com.
Fully and correctly completed Entry Forms received by Studentawards Inc. before the Contest Closing Time will generate a valid “Contest Entry”. Entry Forms which are incomplete, illegible, damaged or irregular, or that contains false information, will not generate a valid “Contest Entry”.
Any person who created or attempts to create a false membership will result in all of that person's Contest Entries to be ruled ineligible, will be disqualified automatically from the Contest, and Studentawards Inc. reserves the right to ban or disqualify such person from entering future studentawards.com contests.

Prizes. There will be one (1) Prize awarded in the Contest consisting of Five Hundred Canadian Dollars (Cdn $500.00).
Any costs associated with the Prize are the responsibility of the winner. The Sponsor will not be responsible or liable for any possible damages or injuries that may occur as a result of the use of a Prize. To be declared a winner, the selected entrant will be required to sign a release, waiver of liability and indemnity in favour of Sponsor.
Odds of winning: Odds of winning will depend on the number of eligible participants who enter the Contest, and the number of Contest Entries submitted or generated before the Contest closing Time.
Total Contest Prize Value: $500.00 Canadian.

Contest Draw Date. One (1) Contest Entry will be drawn at random on January 16, 2013 (the “Contest Draw Date”) at 1:00 p.m. ET, in Toronto, Ontario from all eligible Contest Entries submitted or generated before the Contest Closing Time in accordance with these Official Rules, under direct supervision of the judges, whose decisions regarding this Contest are final in all respects. The Contest entrant whose Contest Entry is drawn (the
“Selected Entrant”) is eligible to win the Prize.
6.
Prize Conditions. The following other conditions apply:
(a) Prize must be accepted as awarded. No substitutions, alterations, cash equivalents or redemptions will be made.
(b) Proof of Canadian citizenship or permanent residence status, and enrolment in a Canadian high school, CEGEP, college, or university may be required in order to claim the Prize.
(c) Prize may not be transferred or assigned except if expressly consented to by Sponsor.
(d) Where applicable, a Contest winner is responsible for all taxes, surcharges and fees associated with receipt or use of the Prize. Any charges and/or expenses not specifically mentioned as included in the Prize are the responsibility of the winner.
(e) The Sponsor does not assume any liability for lost, damaged or misdirected Contest Entries or Prize.
(f) Other restrictions may apply.
7.
How to Win. The
Sponsor will attempt to contact the Selected Entrant (or if the selected entrant is a minor, his or her legal guardian) on or about the Contest Draw Date, by e-mail at the address on the Selected Entrant’s Entry Form. At the Sponsor’s sole discretion, the Sponsor may also attempt to contact the Selected Entrant (
or if the Selected Entrant is a minor, his or her legal guardian) by telephone at the telephone number on the Selected Entrant’s Entry Form.
In order to be confirmed as a winner of a Prize, the Selected Entrant must have complied with and remain in compliance with these Contest Rules, and must have reached the age of majority in their Province of residence not later than time of contest entry. If the Selected Entrant is at least 13 years of age but under the age of majority in his/her Province of residence, that person’s Prize will be awarded to his or her parent or legal guardian, who must accept the Prize on the Selected Entrant’s behalf. The Sponsor reserves the right to verify the age of the Selected Entrant.
In order to receive a Prize, the Selected Entrant (or if a minor, his or her legal guardian) must:
i. correctly answer, without assistance of any kind, a time-limited, mathematical, skill-testing question to be administered at a pre-arranged time by telephone.
ii. complete, sign and return a standard declaration, indemnity and release form, confirming understanding and compliance with the Rules and acceptance of the prize as awarded, and a Release, in a form satisfactory to the Sponsor, releasing the Sponsor, and its affiliates, officers, directors, employees, agents and representatives of all liability arising out of the Contest, including without limitation, the selection of any Prize winner, the administration of the Contest, and the acceptance or the use of any or all of the Prizes as awarded. All forms must be returned to the Sponsor within five (5) days of recipt of the forms. The Sponsor reserves the right to verify the age and proof of enrolment in a Canadian high school, CEGEP or post-secondary school for the 2012-2013 school year of the Selected Entrant.
Should the Selected Entrant not be reached by the Contact Date, for any reason, including, but not limited to, the fact that the Selected Entrant did not provide the correct e-mail address or telephone number, or if that Selected Entrant is unable to answer the skill-testing question or does not meet all of the Contest conditions, the Entrant’s Prize shall be automatically forfeited by that Selected Entrant. In such event, another draw shall then be conducted where one (1) Contest Entry will be drawn at random from among all remaining eligible Contest Entries received before the Contest Closing Time. The Sponsor will attempt to contact the new Selected Entrant within one (1) business day of the time at which such entrant was selected, by email or telephone, and subject to the same conditions as set out in this clause and in these Rules. This process will be repeated until a Selected Entrant is declared the winner of the Entrant’s Prize, or until no Contest Entries remain.
8. By entering the Contest, the winner of a Prize consents to the use of his or her name, city of residence, voice, photograph, video, statements and/or likeness, without additional compensation or permission, except where prohibited by law, in any publicity or advertising in any medium throughout the world in perpetuity carried by or on behalf of Sponsor, its agencies and affiliates.
9. If a selected entrant or declared winner is not in compliance with these Contest Rules, or is found ineligible, the Prize will be forfeited and the process set out in Section 7 above will be followed to select a new winner. The Sponsor reserves the right to disqualify such entrant from the Contest.
10.
General Rules.
a) All Contest entries become the property of Sponsor and none shall be returned.
b) Any entry that is incomplete, illegible, damaged or irregular, or that contains false information is invalid.
c) The Sponsor reserves the right, in its sole discretion, to terminate, close, suspend, reinstate or amend in whole or in part, the Contest at any time without prior notice for any reason whatsoever, and if required, subject to, in the case of Quebec, the consent of the
Régie des alcools, des courses et des jeux.
d) By entering the Contest, each entrant agrees to abide by these Rules, which are subject to change without notice to Contest entrants individually and which changes shall be posted at this page of the Contest website.
e) By entering the Contest, each entrant automatically releases each of the Releasees (as defined below) and any other person or entity associated in any way with the Contest from any and all liability arising in any manner out of the Contest, including without limitation, the selection of any Prize winners, the administration of the Contest, and the acceptance or the use of any or all of the Prizes as awarded.
f) All decisions by the Sponsor with respect to all aspects of the Contest shall be final and binding. All entrants agree to abide by all of the instructions and decisions of the Sponsor. In the event of any dispute regarding the interpretation of these Rules or any decision rendered by the Sponsor, the decision or interpretation of Sponsor shall prevail.
g) Any attempt to tamper with the entry process, to interfere with the Contest or these Rules, to deliberately damage any website or to undermine the administration, security or legitimate operation of the Contest, may be a violation of criminal and civil laws and the Sponsor reserves the right to seek damages or other relief or both from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying entrants from this and future Sponsor Contests.
h) The Releasees are not responsible for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. The Releasees are not responsible for any liability for damage to any computer system or other electronic device resulting from participation in or accessing or downloading information in connection with this Contest.
i) The Sponsor does not assume responsibility of any nature whatsoever in all cases where the inability to hold the Contest results from any event beyond the reasonable control of Sponsor, including without limitation, any Act of God, any strike, lock-out or other labour conflict, war, act of terror, unavailability of any Website, or should a virus, worm, bug or other cause beyond the reasonable control of Sponsor corrupt the security, data integrity, or proper administration of the Contest.
j)
Privacy. By entering the Contest, an entrant consents to the use by the Sponsor of the personal information submitted with such entry both for the purpose of administering the Contest and for the purposes as described in the Studentawards Inc.
Privacy Policy. In addition, by entering this Contest, an entrant consents to the use of such personal information by the Sponsor to contact the entrant before the Contest Closing Time to promote the Contest and Sponsor offers. If available, by specifically checking an additional Sponsor information check-box on the Entry Form, an entrant consents to the Sponsor using the personal information submitted with such entry to contact the entrant in the future to provide electronic newsletters and mailings, and other promotions and product and/or service offerings of the Sponsor. The entrant may withdraw its consent at any time by emailing support@studentawards.com.
k)
No Liability of Releasees. None of the Sponsor, its associates, directors, officers, employees, agents, representatives, successors and assigns (collectively, the
“Releasees”) are responsible for any negligence, claims, liability, injury up to and including death, property loss or other damage to any entrant or winner arising from or in connection with the acceptance, redemption or use/misuse of a Prize or participation in this Contest. The Prize winner(s) assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of the Prize.
l) The Releasees shall not be responsible for entries not received or not considered eligible due to incomplete, inaccurate, unclear or indecipherable information, failed or interrupted network connections or other mechanical or technical problems, however caused, (including a busy phone signal). The Releasees shall have no liability for lost, stolen, delayed, damaged or misdirected Contest entries, or for any failure, interruption, delay, error or omission of the Contest website, Sponsor websites or any other website(s) used during or for the purpose of participating in the Contest (the
"Website(s)") or features on the Websites during the Contest, for any problems related to the Websites or the Contest website, including mechanical or technical malfunction of, or damage to, any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, for failure of any email or Contest entry to be received by Sponsor for any reason, for damage to an entrant's or any other person's computer or other electronic device(s), or for breaches of privacy for any reason beyond the control of the Releasees, including interference by third party computer "hackers".
11. This Contest is subject to all applicable federal, provincial and municipal laws and is void outside Canada or where prohibited by law. Any dispute arising hereunder shall be adjudicated in the applicable court in Toronto, Ontario. For residents of Quebec: any litigation respecting the conduct or organization of a publicity contest may be submitted to the
Régie des alcools, des courses et des jeux for a ruling; and any litigation respecting the awarding of a Prize may be submitted to the
Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.
12. If any provision of these Rules or the application thereof to any person or circumstance shall, to any extent, be invalid or unenforceable, the remainder of these Rules, or the application of such provision to persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected thereby and each provision of these Rules shall be valid and enforced to the fullest extent permitted by law and be independent of every other provision of these Rules.
